SUPPLY OF GOODS
Where there is any conflict between these conditions and any proposed by the buyer of the goods (“the buyer”) these terms and conditions shall apply. The seller must specifically agree any condition, which the buyer wishes to apply on any supply of goods, in writing.
Any order accepted by the seller shall be subject to the seller’s conditions of sale and no other conditions shall apply unless expressly agreed in writing by the seller.
The submission of your order will form an offer to purchase the goods and our email accepting your order will constitute the formation of a legally binding contract between us.
REPRESENTATION OF GOODS
Eco eMart Shop reserve the right to make changes in the specification of the goods which are required to conform with any applicable statutory requirements, or where the goods are to be supplied to Eco eMart Shop specifications, which do not materially affect their quality or performance.
Whilst all sizes and measurements are approximate only, we will use our best endeavours to ensure that they are as accurate as possible.
Such descriptions whilst given as a guide, in good faith, are subject to alteration by the seller without notice. All weights and dimensions are approximate only.
The seller reserves the right, should circumstance dictate, to supply a product of a specification that differs from that detailed in the catalogue.
In such cases every effort would be made to supply a product of at least the same quality.
Where products are manufactured or adapted to the buyer’s own specification the seller accepts no responsibility as regards the fitness for purpose of the products so supplied, and those goods are not returnable for credit without the specific prior written agreement of the seller.
PRICING
All prices quoted by the seller are subject to alteration without notice unless otherwise expressly agreed in writing by the seller or stated expressly in the form of tender issued by the buyer.
All prices quoted by the seller are exclusive of VAT which shall be charged on invoices at the current rate.
Quoted prices include a delivery charge within mainland UK, excluding the Highlands and Islands. For deliveries outside this area, and overnight deliveries where requested, a carriage charge will be levied. The prices invoiced will be those currently charged by the seller at the date of despatch.
SALE
A percentage discount is applied to the original full price of eligible items whereby the original full price and the new discounted price will be displayed.
We reserve the right to add or remove items from the sale and to amend discounts and prices at our discretion. Return collections must take place within three days of the return request. Items returned to us in accordance with our terms and conditions will be refunded or exchanged for the total item value paid.
We reserve the right to change the Terms and Conditions of this offer at our sole discretion.
PAYMENT
Preferred method of payment is by credit/debit card or cheque.
All our online credit card transactions are processed through our partners Stripe.com.
All Government bodies including Councils, Schools, Universities, NHS etc. qualify for instant credit facilities.
INSOLVENCY OF SELLER
The Terms may be terminated by Office Hut Group, if at any time the buyer ceases trading, or become apparently insolvent or have a trustee in sequestration appointed, combine with your creditors, or have a liquidator, receiver or administrator appointed over all or any of your assets other than for the purposes of amalgamation or reconstruction or undergo any analogous act or proceeding under foreign law.
RETENTION OF OWNERSHIP
Ownership of the goods remains with the seller until cleared payment has been received in full.
Until full payment is received Eco eMart Shop may at any time recover the goods and may enter the buyer’s premises for this purpose.
Nevertheless, the risk in the goods passes to the buyer on delivery and the buyer shall promptly affect and maintain in the joint names of the parties, insurance of the goods against loss or damage in their full invoice price until final payment.
DELIVERY
Deliveries are made Monday – Friday between 8.30am-5.30pm (excluding bank holidays).
Delivery timings are estimates only and whilst we endeavour to get the item to you as soon as possible, please allow the maximum time as set out in our delivery options when ordering.
We aim to deliver a very high standard of service and we will make every effort to deliver the Goods as near to the specified delivery date as possible, however delays are sometimes inevitable due to unforeseen factors. Eco eMart Shop will not be liable for any delay in delivery of the goods howsoever caused.
Products may be despatched from various regional distribution centres. Therefore, orders with multiple items may not all arrive at the same time.
The seller accepts no liability for any loss, damages or expenses arising from the late delivery of goods by the seller, its agents, or its agents’ carriers due to any cause whatsoever.
The seller will, seek to achieve delivery dates specified as far as it is within its power to do so. Should you have a particular delivery requirement please enquire before placing your order. An additional charge may be levied for deliveries within a specified timeframe, e.g., 9am – 1pm.
We also make many deliveries to non-UK mainland locations including the Islands of Scotland (Shetland, Orkney, Hebrides), Northern Ireland, Isle of Wight, Isles of Scilly, Republic of Ireland, Guernsey, and Jersey. DAMAGE OR LOSS OF GOODS
Responsibility for damage to or loss of goods in transit prior to the passing of the risk in the goods will only be accepted by the seller if the buyer notifies the seller within two working days of delivery in the case of damage or within two working days from the date of receipt of invoice in the case of loss or non-delivery.
Claims for shortages or damage will not be accepted after a clear receipt has been given to the seller or the seller’s agent. If goods cannot be examined on delivery, delivery sheets or documents presented to the buyer should be signed “Unexamined” and any damage or shortage discovered after examination of the goods notified in writing to the seller within two working days after delivery.
It will be the Seller’s responsibility to check that the number of boxes or items delivered matches the accompanying consignment note before signing.
Risk of damage to or loss of the goods will pass to you at the time when Eco eMart Shop has tendered delivery of the goods.
CONSEQUENTIAL LOSS
Except in respect of death or personal injury caused by the seller’s negligence, or as herein provided, the seller shall not be liable to the buyer for any consequential loss or damage (whether for loss or profit or otherwise) costs or expenses or their claims for consequential loss whatsoever which arise out of or in connection with the supply of the goods or their use or re-sale.
CLAIMS
Notification of non-delivery must be made in writing within 7 days of invoice date and for shortages or damage within 3 days of receipt of goods. Failing this no claims will therefore be entertained.
RETURNS
Goods will be accepted back for credit only with the express permission of Eco eMart Shop. Please contact us for instructions on point of delivery.
Made-to-order items cannot be accepted back into stock. If you need to cancel your made-to-order items for any reason, this can only be accommodated within 24 hours of placing the order.
If a cancellation is possible after 24 hours, Eco eMart Shop will charge a cancellation fee as it is unlikely that we could re-sell made-to-order items to another customer.
Made-to-order items cannot be cancelled after despatch from the warehouse. Refused deliveries of made-to-order items are not eligible for credit. Our usual refund policy does not apply to made-to-order items, which cannot be returned or exchanged unless faulty.
The above conditions do not affect your statutory rights when goods are faulty, or not as described. Goods must be returned in their original packaging, unused, unassembled and in a re-saleable condition.
Credit shall not be given for goods received damaged. The buyer shall unless otherwise stated be responsible for the cost of the return carriage of all goods returned which shall be at the risk of the buyer until actual receipt of the goods to Eco eMart Shop.
Proof of return delivery will remain with the buyer. We reserve the right to charge for incomplete returns, orders placed in error or not wanted.
WARRANTIES & LIABILITY
Subject to the conditions set out below Eco eMart Shop warrants that the goods will correspond with their specification at the time of delivery.
Where Eco eMart Shop sells goods supplied by a Third Party, Eco eMart Shop does not give any warranty, guarantee or other term as to their quality, fitness for purpose or otherwise, but will assign to you the benefit of the manufacturer’s warranty given by the third party supplying the goods to Office Hut Group.
The above warranty will be assigned by Eco eMart Shop subject to the fact that Eco eMart Shop shall be under no liability in respect of any defect arising from fair wear and tear, wilful damage, negligence, abnormal working conditions, storage in a hostile environment, failure to follow Eco eMart Shop instructions or a third party’s instructions (where the Goods have been supplied by a third party to Eco eMart Shop– whether oral or in writing) misuse or alteration or repair of the goods without Eco eMart Shop approval.
INTELLECTUAL PROPERTY
To the fullest extent permitted by law, Eco eMart Shop is providing this website and its contents on an ‘as is’ basis and makes no (and expressly disclaims all) representations or warranties or any kind with respect to this web site or its contents including, without limitation, warranties of merchantability and fitness for a particular purpose. In addition, Eco eMart Shop does not represent or warrant that the information accessible via this web site is accurate, complete, or current.
None of the content of this web site may be copied or otherwise incorporated into or stored in any other design, logo, web site, electronic retrieval system, publication, or other work in any form (whether hard copy, electronic or other).
EVENTS OUTSIDE OUR CONTROL
We will not be liable or responsible for any failure to perform, or delay in performance of, the products that is caused by an event outside our control. This does not affect your statutory rights.
